The day after the baby’s birth, Dr. Holterman performed what is typically a routine surgery to repair the condition. Following the procedure Dr. Holterman failed to exercise due care and began a series of 24 experimental procedures on the child that were not authorized by the hospital and were not pursuant to clinical trial protocol. The final surgery culminated in an inappropriate, off-label use of an endocelose needle that severed the child’s pulmonary artery, resulting in profound, irreversible brain injury and cerebral palsy.

This lawsuit was the largest settlement for a child born with esophageal atresia in Illinois and the fourth largest medical malpractice suit of a minor in Illinois.
