$3,000,000 Settlement – Failure to Diagnose Emergency Room Malpractice Septic Shock Wrongful Death

A 39-year-old female, who had a history of uncontrolled diabetes, presented to defendant E/R with fever and renal pain. A CT scan revealed a 5mm obstructing kidney stone. Those findings, along with bloodwork, indicated a severe infection that warranted an emergent surgical decompression. Instead, the defendant staff discharged her and instructed her to follow up with her primary care provider. Her condition deteriorated, and she returned the next day. The defendants failed to respond in a timely manner, performing surgery 15 hours later, but by that time, any intervention was too late. The Plaintiff suffered sepsis, septic shock, and death. Her parents and three sisters survived her.
