$28,700,000 Verdict - Medical Malpractice

Partner Joseph E. Kolar and others obtained a $28.7 million wrongful death verdict on Monday, May 8, 2023, against a Chicago-area hospital.  The case was tried in the Daley Center beginning April 24 and concluded on May 8 with the verdict after 3 hours of deliberations by the jury.

The decedent was a 44-year-old woman, who was married and had one adult daughter, had a condition called Cyclic Vomiting Syndrome. After four days, her doctor discharged her with an extremely high WBC (white blood cell count) and other abnormal labs indicating severe dehydration (hypovolemia) without obtaining specialist consultations during the hospitalization. At home on the day of discharge, the woman collapsed from hypovolemic shock, which led to bowel death and a nine-month hospitalization until she died.
